1. Acceptance of Terms
By using FailZero Infrastructure Group ("FailZero", "we", "our", "us") services, you agree to these Terms of Service. If you do not agree, do not use our services.
2. Services Provided
FailZero provides hosting, disaster recovery, and continuity engineering services. Specific offerings are listed on our site and may change over time. We reserve the right to refuse service at our discretion, especially in cases of abuse, illegal activity, or violation of these terms.
3. Customer Responsibilities
- You are responsible for the content you host or process on our systems.
- You must comply with applicable laws and regulations.
- You must maintain current and accurate contact/billing information.
- You are expected to take reasonable security measures (e.g., strong passwords, access control).
4. Acceptable Use
You may not use FailZero services for:
- Illegal activities (including copyright infringement, fraud, or harassment).
- Hosting or distributing malware.
- Abuse of network resources (spam, DDoS, resource exhaustion).
- Activities that cause harm to FailZero or other customers.
Violations may result in suspension or termination without notice.
5. Data & Backups
FailZero emphasizes recovery and resilience. However:
- No system is invulnerable. We cannot guarantee absolute data protection.
- Customers are encouraged to maintain independent backups.
- We may keep operational logs and technical metadata for service delivery.
6. Service Levels & Uptime
We design for continuity, but we do not guarantee uninterrupted uptime. Any SLA (Service Level Agreement) must be documented separately in writing.
7. Payment & Billing
- Services are billed as agreed at sign-up.
- Invoices must be paid on time to avoid suspension.
- All fees are non-refundable unless explicitly stated.
8. Termination
Either party may terminate service with written notice. FailZero may terminate immediately in cases of abuse, non-payment, or legal violation.
9. Limitation of Liability
FailZero is not liable for indirect, incidental, or consequential damages, including lost profits or data. Liability is limited to the fees paid for the affected service period.
10. Changes to Terms
We may update these Terms from time to time. Continued use of services after changes constitutes acceptance.
